Georgia Supreme Court orders report released By Karen Bennett The Associated Press ATLANTA The Georgia Supreme Court on riday ordered the state to make public a 3500 page report detailing a Georgia Bureau of Investigation probe into allegations of ticket fixing in the Georgia State Patrol The ruling came as state officials were preparing to voluntarily release the bulk of the report which led to the firing Wednesday of Col Hugh Hardison the patrol commander The bulk of the report a 22 foot high stack of more than 3200 pages organized into 30 folders each contain ing daily reports on the course of the investigation was distributed to the news media about 4:30 pm riday The release had been expected earlier riday but Attorney General Michael Bowers said it was delayed while officials took out about 300 pages of information on matters still under investigation or that had no relevance whatsoever to the matter but if it came out it would be an illegal invasion of Bowers said most of the deleted information covered allegations that Hardison and other top State Patrol officials had used their offices to obtain free accommo dations at Callaway Gardens a west Georgia resort Bowers said the Callaway Gardens information had been turned over to the US office for investi gation for possible federal criminal charges But the Supreme Court in a unanimous decision agreed with a Superior Court judge who had rejected Bowers' argument that the Callaway Gardens informa tion was part of an ongoing investigation public has a right to public the Supreme Court wrote in its brief decision saying the trial court judge was correct to rule that the investiga tion had been completed After meeting with other state officials late riday Bowers said the net effect of the high order would be that most of the remaining portions of the report would also be released Bowers said the GBI will make copies of the deleted Callaway Gardens portion available on Monday He said eight GBI employees had worked six hours riday to copy the rest of the file "and not going to make them work on the Less than 10 pages worth of material will remain deleted from the public file he said adding that those items involve brief references to other ongoing investi gations data from BI background checks irrele vant violations listed on various records and other items that be exempted (under federal privacy law) in any event" THE COURT DECISIONS ordering release of the report resulted from a suit filed by The Atlanta Journal and The Atlanta Constitution who were joined by radio station WGST and WSB TV The suit argued that Gov Joe rank Harris was violating the Open Records law by witholding the report The Supreme Court also affirmed the lower order that the Public Safety Board give to it under seal minutes of an Aug 21 executive session in which the board voted to retain Hardison but strip him of his power to make personnel decisions The Supreme Court said it wanted to review the minutes to see if the board members were correct in considering the report privately Bowers had appealed the lower court decision saying that the report should remain confidential because the investigation had been turned over to federal auth orities to determine whether Hardison had violated federal laws forbidding public officials from using their offices for private gain He also said the report should be kept secret because the Public Safety Board which oversees the State Patrol and the GBI might consider personnel changes The Supreme Court noting firing from his $68000 a year position said the of personnel action is OLLOWING THE IRING of Hardison on Wednes day a 410 page portion of the report was made public That portion which had been given to the board before it voted included a 36 page summary plus copies of 10 affidavits and summaries of interviews obtained in the course of the probe The summary written by DG Robertson the assis tant special agent in charge of the investigation said that various troopers had reported being pressured into voiding traffic tickets issued to people related to Cal laway Gardens and that Hardison and other top officials had received free accommodations from the resort apparently in exchange for fixing the tickets Braswell: I tried to stop ticket fixing The Associated Press ATLANTA The man who has temporarily replaced Col Hugh Hardison as head of the Georgia State Patrol told Georgia Bureau of Investigation agents he tried for at least two years to get Hardison to stop the widespread practice of ticket fixing Maj Tom Braswell was appointed Wednesday by the Pub lic Safety Board to replace Har dison The board had fired Hardison earlier that same day in an executive session The firing was the culmination of a four month GBI investigation which uncovered a pattern of fre quent ticket alterations for promi nent Georgians It also raised allegations that Hardison used his position for private gain comments were included in the complete 3500 page report released ri day The 29 year veteran and Americus resident admitted that he has voided traffic citations and requested other troopers to do like wise But he said he never attempted to pressure the deci sions of other troopers and has never received a gratuity to void a ticket BRASWELL who lives during the week in an apartment at the Department of Public Safety in Atlanta told investigators that Hardison who lives in the same building keeps four cars at his apartment: two unmarked luxury ord Crown Victorias a marked ord and an unmarked ord Braswell said two years ago he and Maj CR Pinyan asked Sgt Danny Butler to prepare a policy statement to guide troopers in decisions about fixing tickets But Hardison never took action on their proposal Braswell said which would have required troop ers to state the reason for voiding the ticket and to list the names of whoever requested that a ticket be altered Braswell said that in April 1986 he offered to begin an internal investigation into allegations reported in the media of ticket fix ing He said Hardison told him to wait Later Braswell said Hardison told him he would ask Maj KC Rearden to conduct an internal investigation Hometown gives Hardison welcome The Associated Press CEDARTOWN hometown of fired State Patrol Commander Hugh Hardison was decked out in yellow ribbons riday to welcome the colonel home "He is well loved and well liked" said Susan Parker whose Cedartown travel agency was adorned with a sign welcoming Hardison back to town "We will certainly welcome him back with open she said Hardison was fired Wednesday by the state Public Safety Board in the wake of a Georgia Bureau of Investi gation report on ticket fixing by state troopers and gratuities received by patrol personnel including Har dison But many people in the 57 year old home town said openly riday that they felt the colonel was done wrong "The whole town is in an uproar over this" said Polk County Tax Commissioner Dan Casey "Hardison has never done anything ma jor wrong in his life This is a railroad Parker said A neighbor of Phil Brewster who was the first commander of the Georgia State Patrol in the 1930s was at a loss for words over the firing "I just know what to say" he said "I think terrible final truth come out I think honest and has made an excellent commissioner just sorry it
